Terms and Conditions of Sale

These terms of sale are entered into between the company SOULBEATS RECORDS, with its registered office at 53 route des Gunes, 33250 CISSAC-MEDOC, hereinafter referred to as “the SELLER,” and any individual or legal entity wishing to make a purchase through the website of “SOULBEATS MUSIC,” hereinafter referred to as “the BUYER.”

Purpose

These terms of sale aim to define the contractual relationship between SOULBEATS RECORDS and the buyer and the conditions applicable to any purchase made through the online store of SOULBEATS RECORDS, whether the buyer is a professional or a consumer. The acquisition of a product or service through this site implies an unconditional acceptance by the buyer of these terms of sale. These terms of sale prevail over any other general or specific conditions not expressly agreed upon by SOULBEATS RECORDS.
SOULBEATS RECORDS reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in effect on the date of the order by the buyer.
Characteristics of the goods and services offered: The products and services offered are those listed in the catalog published on the SOULBEATS RECORDS website. These products and services are offered within the limits of available stock. Each product is accompanied by a description provided by the supplier; for some of them, bearing the DF mention, the buyer may have access to the supplier’s documentation.
The photographs in the catalog are as accurate as possible but cannot ensure a perfect similarity with the product offered, particularly with regard to colors.

Prices

The prices listed in the catalog are inclusive of VAT in euros, taking into account the applicable VAT rate on the day of the order; any change in the rate may be reflected in the price of the products or services.
SOULBEATS RECORDS reserves the right to change its prices at any time, provided that the price listed in the catalog on the day of the order will be the only one applicable to the buyer.
The prices indicated include transport and delivery costs, provided they take place in the geographical areas specified below.

Geographical Area

The online sale of products and services presented on the website is reserved for buyers residing in the specified geographical areas.

Orders

The buyer who wishes to purchase a product or service must:
• Create an account on the SOULBEATS MUSIC website, providing all the requested information;
• Fill out the online order form, giving all the references of the chosen products or services;
• Validate the order after verifying it;
• Make the payment under the specified conditions;
• Confirm the order and payment.
The confirmation of the order implies acceptance of these terms of sale, acknowledgment of having perfect knowledge of them, and waiver of the buyer’s own purchase conditions or other conditions.
All the provided data and the recorded confirmation will constitute proof of the transaction. The confirmation will serve as a signature and acceptance of the operations carried out.
The seller will communicate confirmation of the registered order by email.

Right of Withdrawal

Non-professional individual buyers have a withdrawal period of seven days from the delivery of their order to return the product to the seller for exchange or refund without penalty, except for return costs.

Payment Methods

The price is payable upon ordering.
Payments will be made by credit card, bank transfer, or PayPal account; they will be made through a CB payment module that uses the SSL (Secure Socket Layer) protocol, so that the transmitted information is encrypted by software and no third party can access it during transport on the network.
The buyer’s account will only be debited when the products or services available are shipped and for the amount of the products or services sent or downloaded.
At the buyer’s request, an invoice showing the VAT will be sent on paper.

Deliveries

Deliveries are made to the address indicated in the order form, which can only be within the agreed geographical area.
The risks are borne by the buyer from the moment the products leave the premises of SOULBEATS RECORDS. In the event of damage during transport, a reasoned complaint must be made to the carrier within three days of delivery.
The delivery times provided are for reference only; if they exceed sixty days from the order, the sales contract may be terminated and the buyer refunded.

Warranty

All products supplied by the seller benefit from the legal guarantee provided for in articles 1641 and following of the Civil Code.
In the event of non-conformity of a product sold, it can be returned to the seller, who will take it back, exchange it, or refund it.

Liability

All elements of the SOULBEATS MUSIC website are and remain the intellectual and exclusive property of SOULBEATS RECORDS.
No one is authorized to reproduce, exploit, redistribute, or use, in any capacity, even partially, elements of the website, whether software, visual, or sound.
Any simple or hypertext link is strictly prohibited without the express written consent of SOULBEATS RECORDS.

Personal Data

In accordance with the law relating to information technology, files, and freedoms of January 6, 1978, personal information about buyers may be subject to automated processing.
SOULBEATS RECORDS reserves the right to collect information about buyers, including through the use of cookies, and, if desired, to transmit the collected information to business partners.
Buyers may object to the disclosure of their contact information by notifying SOULBEATS RECORDS. Similarly, users have the right to access and rectify their data, in accordance with the law of January 6, 1978.
The automated processing of information, including the management of users’ email addresses on the site, has been declared to the CNIL on 27-08-2012 under number 1611194 v 0.

Archiving / Proof

SOULBEATS RECORDS will archive order forms and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of Article 1348 of the Civil Code.
The computerized records of SOULBEATS RECORDS will be considered by the parties as proof of communications, orders, payments, and transactions between the parties.

Dispute Resolution

In the event of a dispute, jurisdiction is granted to the competent courts of Paris, notwithstanding multiple defendants or third-party proceedings.
